Tracereporters –A criminal breach of trust and fraudulent act to cheat one Mallam Chubado Tijjani Babbi was established today against Abdulrahaman Aliyu, an indigene of Adamawa State.

Abuja Judicial Division High court of the federal capital territory on three count charges slammed Aliyu six years imprisonment under pretense and dubious means used Echo Logistics Limited company and dumped Babbi two hundred and fifty million naira (250,000,000) for Business pretense.

The Financial intelligence unit of the Economy Financial crime commission (EFCC) who are the prosecuting agents dragged Aliyu before the honorable court and the sentence was passed by Justice F Emessiri.

The Honorable Judge indicted Aliyu on three count charges and stated that sometime between July 2018 to July 2019 in Abuja within the jurisdiction of the honorable court while being one of the directors of Echo logistics limited and haven entrusted with certain property, Babbi transferred the sum of two hundred and fifty million nairas (N250,000,000) being investment money for the business of telecom bill recharge card sales into Echo Logistics limited account domiciled in Jaiz Bank with account number 0002518093 and he was the sole signatory.

Justice Emessiri while delivering judgment said she found him guilty of all the three count charges and did commit criminal breach of trust by dishonesty misappropriating the said sum in violation of the agreement in which such trust was to be discharged and is thereby committed an offense contrary to section 311 of the penal code law and punishable under section 312 of the same law.

According to her, the Nominal complainant (Babbi) is a victim of the defendant (Abdulrahaman ) swindling attitude bordering on forgery of documents, presentation of forged documents for financial transactions, and misappropriation.

She further accused him of forging a document titled “Investment of two hundred million” purportedly signed by one Aliyu Yahaya Lawal with intent to commit fraud and also diverting the said sum to his personal use funds entrusted to him by Babbi

“I find you guilty of all the three count charges and therefore this is my judgment. Count one you will spend one year in jail, Count two you will spend two years, and Count three it is three years you will spend in prison.” Justice Emessiri said

She however gave him an option of a fine of the total sum of One million three hundred thousand (N1,300,000) of all the three count charges when Abdulrahman pleaded guilty and the court should tempted Justice with Mercy considering him a breadwinner of the family suffering from cancer, a life-threatening illness, and has Children who are dependants
